5. User Content and Media

User Content

You retain ownership of the photos, images, text, and other content you upload to the Services (“User Content”). You are solely responsible for your User Content and represent and warrant that you have all rights, licenses, permissions, and consents necessary to upload, store, use, and publicly display that User Content through the Services. You are also responsible for ensuring that your User Content does not infringe, misappropriate, or violate the rights of any third party, including intellectual property, privacy, publicity, and contractual rights.

License to Bladezy

You grant Bladezy a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, display, reproduce, format, resize, optimize, and otherwise use your User Content solely as necessary to provide, maintain, secure, support, and improve the Services. This license includes the right to make your User Content available to the public when you assign or publish that content to public-facing areas of your site.

Public Display of Media

Certain User Content, including photos assigned to public-facing areas of your site, may be visible to customers and other visitors on the internet. You are solely responsible for deciding which User Content you make publicly available through the Services.

Prohibited Content

You may not upload, store, or publish User Content that is unlawful, infringing, defamatory, harassing, threatening, deceptive, invasive of privacy, non-consensual, or otherwise harmful. Bladezy may remove, disable, reject, or restrict access to User Content that we reasonably believe violates these Terms, applicable law, the rights of others, or the integrity of the Services.

Removal, Suspension, and Enforcement

Bladezy reserves the right, but not the obligation, to review, refuse, remove, disable access to, or restrict User Content at any time, with or without notice, if we reasonably believe the User Content violates these Terms, creates legal or security risk, is subject to a complaint, or is otherwise harmful to Bladezy, the Services, or third parties.

Retention and Deletion

Deleted, replaced, or unassigned media may remain temporarily available for operational, backup, legal, security, or recovery purposes, but Bladezy is not obligated to retain such content and may permanently delete it in accordance with its retention practices. Once permanently deleted, User Content may not be recoverable.

Third-Party Infrastructure

Bladezy may use third-party infrastructure and service providers to store, process, secure, cache, optimize, and deliver User Content and other service data.

Copyright Complaints

If you believe content made available through the Services infringes your copyright, you may submit a notice to Bladezy’s designated copyright contact in accordance with applicable law. Bladezy may remove or disable access to allegedly infringing content and may suspend or terminate repeat infringers where appropriate.

User Content Liability

To the maximum extent permitted by law, Bladezy is not responsible for User Content uploaded, published, or otherwise made available by users, including any infringement, misappropriation, defamation, privacy violation, or other claim arising from such User Content.
